The law protects the relationship between a client and a psychotherapist, and information cannot be disclosed without written permission. However, I am a mandated reporter.
Under Texas state law, there are three exceptions to confidentiality:
- If I suspect abuse, neglect, or exploitation of a child, elderly person, or disabled person, I am required by law to report this to CPS or APS, even if it is only a suspicion.
- If a judge subpoenas my records, I am required to turn them over even without your consent.
- If a client intends to harm himself or herself, I will make every effort to enlist their cooperation in ensuring their safety. If they do not cooperate, I will take further measures without their permission that are provided to me by law in order to ensure their safety.
